1. Who We Are

Prompito is a Chrome extension and web service operated by Prompito ("we", "our", "us"). Our website is prompito.com. For any questions about these Terms, contact us at support@prompito.com.

2. Accepting These Terms

By installing the Prompito Chrome extension, creating an account, or using any part of the service, you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated into these Terms by reference.

If you are using Prompito on behalf of an organisation, for example as part of a Teams plan, you represent that you have the authority to bind that organisation to these Terms, and "you" refers to both you individually and that organisation.

If you do not agree to these Terms, do not install or use Prompito.

3. Eligibility

To use Prompito, you must:

• Be at least 16 years old (or 13 in the United States, subject to parental consent)
• Have the legal capacity to enter into a binding agreement in your jurisdiction
• Not be located in a jurisdiction where use of the service is prohibited by law
• Not have had a previous Prompito account terminated for a violation of these Terms

Prompito is not directed at children. If we discover that a user is under the applicable minimum age, we will delete the account immediately.

4. Description of Service

Prompito is a Chrome extension that operates as a floating AI-powered quality layer on top of ChatGPT, Claude, and Gemini. It provides three core functions:

• Phase 1, Prompt Enhancement: Analyses your prompt, identifies gaps, and produces an enhanced version that you may insert into the AI platform of your choice.
• Phase 2, Output Detection: Automatically detects when the AI platform has finished generating a response.
• Phase 3, Output Evaluation: Evaluates whether the AI's response delivered what the enhanced prompt requested, and provides a correction prompt if gaps are found.

Prompito uses the Claude API internally to power its enhancement and evaluation functions. It does not control or guarantee the behaviour of ChatGPT, Claude, or Gemini.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice. We will not make material changes that degrade the core functionality of a paid plan without providing at least 14 days' notice and a prorated refund option.

5. Plans, Cycles and Billing

Plans and cycle allocations

What is one cycle?

One full cycle = Phase 1 (prompt enhancement) + Phase 2/3 (output evaluation). Enhancement alone without evaluation consumes 0.5 cycles. A task requiring one correction round uses 2 full cycles. Unused cycles do not roll over between billing periods.

Billing

All payments are processed by Lemonsqueezy, our Merchant of Record. By purchasing a paid plan, you authorise Lemonsqueezy to charge your payment method on a recurring basis (monthly or annual) until you cancel. You will receive a receipt from Lemonsqueezy for every charge.

Prices are displayed and charged in US Dollars (USD). Your bank or card provider may apply currency conversion fees, we have no control over these.

We may change prices with at least 30 days' notice before your next billing cycle. If you do not wish to continue at the new price, you may cancel before the new rate takes effect.

Cycle exhaustion

When your cycles reach zero, your account remains active, it is never deleted or locked. You will be shown an upgrade screen inside the extension. No further enhancement or evaluation requests will be processed until cycles are refilled via upgrade or top-up.

Teams plans

Teams Annual plans are purchased by a designated account owner who manages seat allocation. Cycle pools are per-seat and are not shared across the team. The account owner is responsible for all charges associated with the team account, including seat additions. Team members may not independently modify the team subscription.

6. Free Tier

The Free tier provides 5 one-time full cycles at no cost. No credit card is required to sign up. Free cycles do not reset or expire as long as your account remains active, they are a one-time allocation.

Free tier accounts are subject to the same Acceptable Use policy as paid accounts (Section 9). We reserve the right to limit or remove access to the Free tier at any time, but existing free cycles already allocated will be honoured.

7. Cancellation and Refunds

Cancellation

You may cancel your subscription at any time through the Lemonsqueezy billing portal, accessible from the extension popup under Billing. Cancellation takes effect at the end of your current billing period. You retain access to your cycles and paid features until that date.

Refunds

We offer a 7-day refund on new Pro Monthly and Pro Annual subscriptions from the date of first payment, if you are not satisfied. To request a refund, contact support@prompito.com within 7 days of your payment date with your order details.

Refunds are not available for:

• Renewals of an existing subscription (only the initial purchase qualifies)
• Top-up purchases (cycle top-ups are non-refundable once issued)
• Teams Annual plans after any team member has accepted an invitation and used cycles
• Accounts terminated for violation of these Terms

Approved refunds are processed by Lemonsqueezy and may take 5–10 business days to appear depending on your payment method and bank.

Chargebacks

If you initiate a chargeback or payment dispute without first contacting us, we reserve the right to suspend your account pending resolution. Please contact support@prompito.com first, we are committed to resolving billing issues fairly.

8. Your Account

You are responsible for maintaining the security of your account. Because Prompito uses passwordless magic-link authentication, the security of your account depends on the security of your email inbox.

You must provide accurate information when creating your account and keep it up to date. You may not:

• Create more than one account per person (multi-account abuse is actively detected)
• Share your account or access with others outside of a Teams plan
• Transfer your account to another person without our written consent
• Use another person's account without their permission

You are responsible for all activity that occurs under your account. If you suspect unauthorised access, contact support@prompito.com immediately.

Account deletion is available at any time from the extension popup. Deletion is permanent and irreversible. All personal data is erased within 24 hours. Cancelling your subscription is separate from account deletion, you may cancel billing while keeping your account active until the end of the paid period.

9. Acceptable Use

You agree to use Prompito only for lawful purposes and in a manner consistent with these Terms. You must not use Prompito to:

• Generate, enhance, or evaluate content that is illegal, defamatory, harassing, threatening, obscene, or that violates the rights of any third party
• Produce content designed to deceive, defraud, or manipulate others, including phishing messages, scam emails, or disinformation
• Create content that infringes any intellectual property right, including copyright, trademark, or trade secrets
• Reverse engineer, decompile, or attempt to extract the source code of the extension or backend beyond what is permitted by applicable law
• Automate or script requests to Prompito's backend in a way that exceeds normal human usage patterns or that attempts to circumvent rate limits
• Share, resell, or sublicense access to Prompito features to others not covered by your plan
• Submit Protected Health Information or other data subject to special regulatory protection that Prompito is not certified to handle (see Section 13)
• Probe, scan, or test the security of our systems, or exploit any vulnerability
• Use the service in any way that could damage, disable, or impair our infrastructure or the experience of other users

Accounts confirmed to be in violation may be suspended or permanently terminated without refund.

10. Intellectual Property

Prompito's IP

The Prompito extension, backend service, website, design system, brand name, brand icon, system prompts, question trees, and all other components of the service are owned by Prompito and protected by copyright, trade secret, and other applicable intellectual property laws. Nothing in these Terms grants you any ownership interest in Prompito.

We grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Prompito Chrome extension solely for your own personal or internal business purposes, in accordance with these Terms.

Your IP

You retain full ownership of all prompts you write and all AI outputs you receive. Prompito does not claim any ownership over your content. Your prompts and outputs are not stored by us, see our Privacy Policy for the full data architecture.

By using Prompito, you grant us a limited, temporary, royalty-free licence to process your prompt and AI output solely for the purpose of providing the enhancement and evaluation service during the active request. This licence expires the moment the request is complete and the data is discarded.

Feedback

If you submit feedback, suggestions, or ideas to us, you grant us an irrevocable, worldwide, royalty-free licence to use that feedback for any purpose without obligation to you.

11. Your Content and Responsibility for It

You are solely responsible for the prompts you submit to Prompito and for the content you ultimately publish, send, or act on as a result of using Prompito.

Prompito enhances your prompts and evaluates AI outputs on your behalf, but it does not review your content for legal compliance, accuracy, or appropriateness before you use it. You must review all AI-generated content before using it in any context where it may affect others.

You represent and warrant that your use of Prompito and the content you create with its assistance will not violate any applicable law, infringe any third-party rights, or constitute fraud or misrepresentation.

12. AI Output Disclaimer

AI-generated content can be incorrect, outdated, incomplete, biased, or inappropriate for your specific situation. A Prompito "pass" verdict means the output addressed the elements of your prompt, it does not mean the output is accurate, legally sound, or ready to use without review.

You must always independently review AI outputs before sending them to any third party, publishing them publicly, using them as the basis for professional advice, or relying on them for any decision with significant consequences.

This disclaimer is shown inside the Prompito interface at the end of every evaluation and is non-waivable.

13. Healthcare Users, HIPAA Prohibition

Prompito has not been designed, audited, or certified for use with healthcare data subject to the Health Insurance Portability and Accountability Act (HIPAA) or equivalent national healthcare data laws. No Business Associate Agreement (BAA) is in place.

Healthcare professionals and organisations subject to HIPAA must not submit patient names, diagnoses, medications, treatment records, case details, insurance information, or any other Protected Health Information through Prompito.

This prohibition applies even when using Prompito's built-in privacy warning feature. That feature is a user-facing alert, it does not confer HIPAA compliance or create any BAA relationship.

Violation of this prohibition is a material breach of these Terms and may result in immediate account termination. Prompito accepts no liability for any regulatory penalties, fines, or claims arising from a user's submission of PHI through Prompito.

A HIPAA-compliant enterprise tier is planned for a future version of Prompito. Until that version is released and explicitly marketed as HIPAA-compliant, no use of PHI through the service is permitted under any circumstances.

14. Third-Party Services

Prompito integrates with third-party services including Anthropic (Claude API), Lemonsqueezy (payments), Resend (email), Kit/ConvertKit (lifecycle email), and Railway (hosting). Your use of Prompito is also subject to the terms and privacy policies of these providers where applicable.

Prompito operates as a layer on top of third-party AI platforms, ChatGPT (OpenAI), Claude (Anthropic), and Gemini (Google). We are not affiliated with, endorsed by, or partnered with any of these platforms. We cannot guarantee their availability, behaviour, or continued compatibility with Prompito. If a platform changes its interface in a way that breaks Prompito functionality, we will work to restore compatibility as quickly as possible.

Links to third-party websites on prompito.com are provided for convenience only. We accept no responsibility for their content, terms, or privacy practices.

15. Availability and Uptime

We aim to keep Prompito available and functional at all times, but we do not guarantee uninterrupted or error-free service. The service may be unavailable due to scheduled maintenance, unplanned outages, third-party API disruptions, or events beyond our control.

We maintain a public status page at status.prompito.com where you can check the current status of all service components. Planned maintenance will be communicated at least 24 hours in advance where possible.

We will not issue refunds or cycle credits for outages caused by third-party AI platforms or by circumstances beyond our reasonable control. For outages attributable to our own infrastructure, we will consider cycle credits on a case-by-case basis, contact support@prompito.com.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, Prompito and all related services are provided "as is" and "as available" without warranty of any kind, express or implied.

We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will meet your specific requirements, will be uninterrupted or error-free, or that AI outputs enhanced or evaluated by Prompito will be accurate or suitable for any purpose.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the above exclusions apply to the fullest extent permitted by law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Prompito and its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business, arising from your use of Prompito.

In all cases, our total aggregate liability to you for any claim arising from or related to your use of Prompito shall not exceed the greater of: (a) the total amount you paid to us in the 12 months preceding the claim, or (b) USD $50.

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain liability limitations, in those jurisdictions, our liability is limited to the maximum extent permitted by law.

18. Indemnification

You agree to defend, indemnify, and hold harmless Prompito and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of Prompito in violation of these Terms
• Content you create, publish, or distribute using Prompito
• Your violation of any applicable law or regulation
• Your violation of any third party's rights, including intellectual property or privacy rights
• Your submission of Protected Health Information through Prompito in violation of Section 13

19. Termination

Termination by you

You may stop using Prompito and delete your account at any time from the extension popup.

Termination by us

We may suspend or terminate your account at any time, with or without notice, if you violate these Terms, particularly the Acceptable Use policy (Section 9) or the HIPAA prohibition (Section 13), or if we detect payment fraud, chargeback abuse, or multi-account abuse, or if we are required to do so by law.

For serious violations, termination is immediate and without refund. For lesser violations, we will endeavour to provide notice and an opportunity to remedy before terminating.

Effect of termination

Upon termination, your licence to use Prompito ends immediately and your account data will be deleted within 24 hours. Provisions of these Terms that by their nature should survive termination will do so, including Sections 10, 12, 16, 17, 18, and 20.

20. Governing Law

These Terms are governed by and construed in accordance with applicable international law. For users in the European Economic Area or United Kingdom, nothing in this clause limits your statutory consumer rights under applicable local law.

21. Dispute Resolution

We'd rather resolve any issue informally. If you have a dispute with us, please contact support@prompito.com first and give us a reasonable opportunity to resolve it, we commit to responding within 5 business days.

If informal resolution fails, disputes will be resolved through good-faith negotiation or, if necessary, through binding arbitration. EEA consumers retain the right to bring proceedings in the courts of their country of residence and to use the EU Online Dispute Resolution platform where applicable.

22. Changes to These Terms

We may update these Terms from time to time. For material changes, those that meaningfully affect your rights, obligations, or core service functionality, we will notify you by email at least 14 days before the changes take effect.

If you do not agree to the updated Terms, you should cancel your subscription and stop using Prompito before the effective date. Continued use after the effective date constitutes acceptance of the updated Terms.

23. Entire Agreement and Severability

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prompito with respect to your use of Prompito, and supersede all prior agreements or representations.

If any provision of these Terms is found to be invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions continue in full force.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
